Important Ruling: Hytera's H-Series Found to Unlawfully Use Stolen Motorola Solutions IP

A Major Legal Victory for Motorola Solutions

Earlier today, a U.S. federal court announced a significant ruling in the ongoing legal battle between Motorola Solutions and Hytera Communications. The U.S. District Court for the Northern District of Illinois has determined that Hytera's H-Series products, including both DMR radios and repeaters sold worldwide, continue to unlawfully use Motorola Solutions’ stolen intellectual property (IP).

This landmark finding reaffirms earlier court decisions and highlights Hytera's inability to develop its own technology without relying on stolen trade secrets and copyrighted source code.

Key Highlights from the Hytera Ruling

The court’s decision includes several critical points for anyone using or considering Hytera's H-Series products:

  • Massive Royalties and Interest: The court ordered Hytera to pay Motorola Solutions over $59 million in royalties, plus more than $11 million in interest. This is for the worldwide sales of H-Series products through the first quarter of 2024.

  • Ongoing Royalty Payments: Hytera is now required to pay royalties on all future H-Series products sold globally. These royalties are set at $80.32 per radio unit and $378.16 per repeater.

  • Civil Contempt of Court: This marks the third time since 2023 that Hytera has been held in civil contempt for refusing to comply with court orders. This repeated defiance underscores a pattern of non-compliance and legal risk.

What This Means for Your Business and Two-Way

Radios

Hytera has repeatedly claimed that its “redesigned” H-Series radios were free of stolen IP. The court has now definitively proven this claim to be false. For businesses that rely on critical communications, this raises serious questions about the long-term viability and integrity of Hytera products.

With Hytera facing massive ongoing royalty obligations, it would not be surprising to see price increases passed on to customers to offset these costs. More importantly, this ruling brings into question Hytera’s long-term business stability and its ability to provide reliable service and support.
